Hearing – To consider a 90-Day Variance from District Rules 316.C.2, C.3 and G and 206, Permit to Operate 12345, Conditions 2.b, 4, 6, and 8 submitted on June 2, 2023, for relief from operating vapor recovery equipment at a gasoline dispensing facility until the repairs can be made.
The Petitioner operates the equipment at the gasoline dispensing facility at the Lake Cachuma marina. The equipment described in the Petition undergoes vapor recovery testing. During the vapor recovery testing, there was an initial test failure on the clean air separator and drop tubes. Until the repairs can be made, the Petitioner is requesting relief for continued operation of the equipment without vapor recovery controls.
The Petitioner operates the equipment described in the Petition at the Lake Cachuma marina, located at 2275 Hwy 154, Santa Barbra, California, 93105. The 90-Day Variance, if granted, will allow the Petitioner enforcement relief from August 3, 2023, through August 29, 2023, or the date compliance is achieved, whichever occurs first.
Interim Variance Order 2023-01-I was granted on June 28, 2023, by Hearing Board Member Terence Dressler. Said order remains in effect from June 2, 2023, through August 29, 2023, or the date compliance is achieved, or the date of decision on the Petitioner’s request for a 90-Day Variance, whichever occurs first.
